HIPAA PRIVACY, SECURITY, AND BREACH NOTIFICATION

The Trustees of Teamsters #261 & Employers Welfare Fund, its employees, and all Business Associates providing service to the Fund, respect your right to the privacy of your health information.  This Fund has followed a Privacy Policy which complies with federal laws and regulations under the Health Insurance Portability and Accountability Act (HIPAA), and subsequent regulations setting forth the HIPAA Privacy Rule, the Security Rule and the Breach Notification Rule.

These federal laws define the protections the Welfare Fund and its associates are required to follow in the use and security of individually identifiable health information they maintain or transmit concerning:  an individual participant or dependent past, present or future physical or mental health or condition;  the provision of health care to the individual; or, the past, present, or future payment of the provision of health care to the individual.

The Fund only uses Protected Health Information (PHI) in connection with day to day operational activities.  It does not give or sell your information to parties who are not engaged in operational activities.  The Fund has instituted measures to safeguard your protected health information, whether on paper files or electronically stored or transmitted.

The Fund will adhere to all of the privacy and security standards and rules issued by the relevant federal agencies.  This includes the Funds encryption of emails containing PHI, as well as the monitoring of data flows and the remediation of discovered privacy or security breaches.  The Fund will issue appropriate notices if there is an individuals information.  The Fund will cooperate with you in the investigation of and response to a breach.
